Terms and Conditions

BioOps is an experimental software tool for storing and reviewing health information you choose to provide. It can display structured laboratory results on the web and mobile dashboards, store health context, review Apple Health records you authorize, store mobile-final health artifacts, and expose selected data to MCP clients you authorize. The mobile app performs supported health calculations locally; the backend stores and serves finalized artifacts without recalculating them. Laboratory data may be entered or changed through an authorized MCP client and is displayed as reported.

BioOps is not intended or supplied as software as a medical device. It is not designed, validated, certified, or intended for a therapeutic purpose, clinical use, patient monitoring, or clinical decision-making. BioOps is not a healthcare provider and does not provide medical advice, diagnosis, treatment, or emergency support. Data, laboratory values, flags, reference ranges, summaries, charts, AI-client output, and MCP responses may be incomplete, delayed, duplicated, unavailable, inaccurate, or misinterpreted. Do not use BioOps to make or delay a medical decision. Consult a qualified healthcare professional for health questions and contact local emergency services for urgent concerns.

BioOps is an early-stage MVP made available for limited evaluation and testing. It is not a production health-record system, diagnostic service, clinical workflow, or guaranteed archive. Features, formats, scopes, calculations, availability, and stored data may change as the product is tested.

• You are responsible for the accuracy, legality, and appropriateness of data you sync or submit, and for having authority to provide it. Do not submit another person's health information unless you are legally authorized to do so.
• You are responsible for your account, devices, sign-in provider, and MCP clients you authorize, including keeping client secrets secure and reviewing requested scopes.
• Verify laboratory values, units, flags, reference ranges, and source provenance against the original report. Keep the original report and independent copies of important information.
• You must not use BioOps to violate law, infringe rights, attack systems, scrape excessively, or harm others.
• You must not rely on BioOps as your only storage location for important health information.

BioOps depends on third-party infrastructure, authentication, Apple Health, and clients you choose to connect. An authorized MCP client may read or change data within its approved scopes and may transmit that data to an AI model or other provider. BioOps is not responsible for third-party services, outages, model outputs, actions, security practices, or privacy practices. Review the scopes, terms, and policies of any MCP client or AI system before authorizing it, and revoke access when it is no longer needed.

You control HealthKit permissions on your device. If you grant access, the BioOps mobile app may read supported Apple Health records, summarize and calculate them locally, and sync finalized artifacts with their source provenance. Raw HealthKit samples are not uploaded for server-side calculation. You can revoke HealthKit permissions in iOS settings and revoke MCP access in BioOps where available.

BioOps stores structured laboratory values and associated report information supplied by you or an authorized MCP client and visualizes that information on supported web and mobile dashboards. BioOps preserves supplied values, units, comparators, flags, and reference ranges; it does not independently verify the report, infer a missing flag, convert units on the backend, or provide clinical interpretation. Source documents are not retained by the laboratory workflow. You must keep the original laboratory report and resolve any discrepancy with the laboratory or a qualified healthcare professional.

Supported web and mobile controls let you request soft deletion of a complete report or an individual result after confirmation. Deleted clinical values stop appearing in ordinary BioOps views, while limited tombstone and audit metadata may be retained for integrity, security, dispute, and legal purposes. Deleting the final active result also removes the empty report from ordinary views. These controls do not replace your right to make an account or privacy request.

BioOps is provided on an as-available basis. To the extent permitted by law, we may at any time modify, disable, suspend, reset, or discontinue any feature, account, or the entire service, and may permanently delete stored data, including without advance notice. Keep independent copies of all important records. We may update these Terms, and material updates may require acceptance before continued use of authenticated features.

To the maximum extent permitted by law, BioOps is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, data preservation, and security. Nothing in these Terms excludes, restricts, or modifies a right or remedy that cannot lawfully be excluded, including any applicable rights under the New Zealand Consumer Guarantees Act 1993.

To the maximum extent permitted by law, BioOps and its owners, operators, contributors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, health outcomes, or business; or claims arising from medical decisions, third-party services, AI-client outputs, unauthorized access, interruption, or data inaccuracies. To the maximum extent permitted by law, the total aggregate liability of BioOps and its owners and operators for all claims relating to the service will not exceed the greater of the amount you paid BioOps in the previous twelve months or NZD $100. This limitation does not apply where liability cannot lawfully be limited.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless BioOps and its owners, operators, contributors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your use of BioOps, your data, your connected clients, your violation of these Terms, or your violation of law or third-party rights.

We may suspend or terminate access if we believe your use creates risk, violates these Terms, would expose BioOps or others to liability, or where the MVP or service is being closed or reset. Suspension or termination may occur without notice where reasonably necessary or permitted by law. You may stop using BioOps at any time, revoke connected clients, and permanently delete your account from Account → Delete BioOps account. The account-deletion control removes your BioOps account, associated health records, notes, laboratory records, mobile credentials, and MCP authorizations. These Terms are governed by the laws of New Zealand. You and BioOps submit to the non-exclusive jurisdiction of the courts of New Zealand. Nothing in this section limits rights you may have under mandatory consumer or privacy law that applies to you.
